Terms of sale

1. Purpose

These Terms of Sale govern all commercial transactions carried out on vizirealm.com between Alessandro Ruggiero (hereinafter "ViziRealm") and its customers (hereinafter "the Customer").

2. Prices and rates

Subscription prices are shown in Swiss francs (CHF), all taxes included, in the configurator. ViziRealm may change its prices at any time. Price changes do not affect ongoing subscriptions before their next renewal date.

The exact price of a configuration is calculated and shown live in the configurator.

3. Subscriptions and automatic renewal

Automatic renewal: All ViziRealm subscriptions renew automatically. When the commitment period chosen at checkout ends, your subscription is renewed for the same length at the same price, and your payment method is charged.

You can cancel your subscription at any time from your account (Settings > Subscriptions > Cancel). The cancellation takes effect at the end of the current period; you retain access to your server until that date.

4. Payment

Payments are processed by Stripe, Inc., a secure payment provider. ViziRealm accepts credit and debit cards (Visa, Mastercard, American Express), digital wallets (Apple Pay, Google Pay, Amazon Pay, Link) and Klarna instalments. Which methods are actually offered at checkout depends on your country, the currency, and whether they support automatically renewing subscriptions.

If an automatic renewal payment fails, Stripe retries the charge up to 8 times over two weeks. Your server is suspended from the first failure and your data is kept; article 8 describes what follows.

5. Delivery

ViziRealm offers instant delivery. Your server is created and accessible immediately after payment confirmation by Stripe, 24/7.

6. Right of withdrawal

Customers residing in the European Union: In accordance with Directive 2011/83/EU, you have a 14-day right of withdrawal from the date of purchase for distance contracts.

Express waiver of right of withdrawal: ViziRealm provides a digital service whose execution begins immediately after order confirmation. In accordance with Article 16(m) of Directive 2011/83/EU, by checking the corresponding box during checkout and requesting immediate execution of the service, you expressly waive your 14-day right of withdrawal. This waiver is confirmed by timestamp in our system.

Customers residing in Switzerland: Swiss law does not provide for a statutory right of withdrawal for distance service contracts. Refund conditions are defined in Article 7 below.

7. Refund policy

Outside of the right of withdrawal (when applicable), ViziRealm may grant a refund in the following cases:

  • Downtime attributable to ViziRealm: see article 8 of the Terms of Service. Beyond 48 consecutive hours, a prorated refund may be requested
  • Technical billing error (double charge, incorrect amount)
  • Technical inability to provide the ordered service
  • Voluntary cancellation: prorated refund for unused remaining days, upon request to support

Refund requests can be sent to support@vizirealm.com or via our Discord. within 30 days of the incident.

8. Suspension and termination for non-payment

Non-payment never leads to immediate deletion. The sequence is as follows:

  • On the first failed charge, your server is stopped and suspended, and you receive an email. No data is deleted and your files remain accessible from the panel
  • The charge is retried automatically up to 8 times over two weeks. As soon as a payment succeeds, the suspension is lifted and you can restart your server
  • If no attempt succeeds, the subscription is cancelled and a 14-day retention window opens: the server stays suspended with its data intact, and you can download it or resubscribe
  • A reminder is sent before the deadline. When it passes, the server and its data are permanently deleted

9. Price changes during subscription

In case of a price increase, the Customer will be notified by email at least 30 days before the renewal date. Without objection before that date, the subscription will be renewed at the new price. The Customer may cancel their subscription before renewal at no cost.

10. Applicable law

These Terms of Sale are governed by Swiss law (Code of Obligations). Disputes relating to a commercial transaction are subject to the jurisdiction of the courts of the canton of Fribourg, subject to mandatory consumer protection rules applicable in the Customer's country of residence.
